Dangerous, Affected and Insanitary Buildings Policy

Council’s Dangerous, Affected and Insanitary Buildings Policy helps protect the community against the risks unsafe buildings can pose – we’re making some changes.

Council is required by the Building Act 2004 to have a policy to manage dangerous and insanitary buildings in Tauranga. The policy is an important tool to help council protect the community against the risks unsafe buildings can pose, and needs to be reviewed every five years.

A large part of the policy is dictated by legislation. The Building Act sets out what the policy needs to contain, and the role of councils in identifying and remedying buildings that present a risk to their communities. Each council decides, through their policies, the approach they will use to do that.

Recommendations from the Ministry of Business and Innovation and Employment (MBIE) have been incorporated into a proposed draft amended Dangerous, Affected and Insanitary Buildings policy.

Council is required to consult with the community on any changes made to this policy, so we’re seeking your feedback on the proposed changes.

You can do this by:

Community consultation opened on Monday 10 February and closed 5pm Monday 10 March 2025

The Building Act requires Council to adopt a policy that sets out:

  • the approach and priorities it will take in performing its functions for managing dangerous, affected and insanitary buildings; and
  • how the policy will apply to heritage buildings.

As required by the Building Act we have reviewed our policy and are proposing a couple of changes. The changes are largely based on MBIE’s recommendations from their recent performance monitoring assessment.
